1. Agreement to Terms
By accessing or using YouthFuel ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
These Terms constitute a legally binding agreement between you and YouthFuel, Inc. ("we," "us," or "our").
2. Description of Service
YouthFuel provides a telehealth platform that connects patients with licensed healthcare providers for testosterone replacement therapy (TRT), weight management, and related health services. The Service includes online health assessments, virtual consultations, prescription management, lab ordering, and e-commerce for health products.
3. Eligibility
To use the Service, you must:
- Be at least 18 years of age
- Be a resident of a state where YouthFuel operates
- Have the legal capacity to enter into binding contracts
- Not be prohibited from using the Service under applicable laws
- Provide accurate and complete registration information
4. Medical Disclaimer
4.1 Not Emergency Services
YouthFuel is NOT an emergency medical service. If you are experiencing a medical emergency, call 911 or go to your nearest emergency room immediately.
4.2 Telehealth Limitations
Telehealth services have inherent limitations. Your provider will determine if telehealth is appropriate for your condition. Some conditions may require in-person evaluation.
4.3 No Guarantee of Treatment
Completing an assessment does not guarantee that you will receive treatment. All treatment decisions are made by licensed healthcare providers based on clinical evaluation.
5. Account Registration
5.1 Account Creation
To access certain features, you must create an account. You agree to:
- Provide accurate, current, and complete information including health history
- Maintain and promptly update your account information
- Keep your password secure and confidential
- Notify us immediately of any unauthorized access
- Be responsible for all activities under your account
5.2 Account Termination
We reserve the right to suspend or terminate your account if:
- You violate these Terms
- You provide false or misleading health information
- Your account poses a security or safety risk
- Required by law or regulatory authority
6. Subscription Plans and Billing
6.1 Treatment Plans
We offer various treatment plans with different services and pricing. Current plans and pricing are available on our Pricing page.
6.2 Billing
- Billing Cycle: Monthly or as specified by your treatment plan
- Payment Method: Credit card or other accepted payment methods via Stripe
- Automatic Renewal: Subscriptions automatically renew unless cancelled
- Price Changes: We may change prices with 30 days notice
6.3 Refunds
- Consultations: No refunds for completed telehealth consultations
- Prescriptions: No refunds for filled prescriptions
- Lab Kits: Unused, unopened lab kits may be returned within 14 days
- Cancellation: You may cancel your subscription anytime; service continues until the current period ends
6.4 Failed Payments
If a payment fails:
- We will attempt to charge your payment method multiple times
- We will notify you via email
- Your account may be suspended after 7 days
- Prescriptions may be held until payment is resolved
7. User Responsibilities
7.1 Health Information
You agree to provide truthful and complete health information. Providing false medical information may result in inappropriate treatment and poses serious health risks.
7.2 Acceptable Use
You agree to use the Service only for lawful purposes. You will not:
- Provide false health information or medical history
- Attempt to obtain prescriptions for unauthorized purposes
- Share your account or prescriptions with others
- Violate any applicable laws or regulations
- Interfere with or disrupt the Service
- Attempt to gain unauthorized access to systems
8. Intellectual Property
8.1 Our Intellectual Property
The Service, including all content, features, and functionality, is owned by YouthFuel, Inc. and protected by copyright, trademark, and other intellectual property laws.
8.2 Your Content
You retain ownership of content you submit to the Service. By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use it for providing the Service.
9. Privacy and Data Protection
Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your personal data in compliance with HIPAA and other applicable laws.
By using the Service, you consent to our data practices as described in the Privacy Policy.
10. Limitation of Liability
To the maximum extent permitted by law:
10.1 Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.
10.2 Limitation of Damages
IN NO EVENT SHALL YOUTHFUEL BE LIABLE FOR:
- Indirect, incidental, special, or consequential damages
- Loss of profits, revenue, data, or business opportunities
- Damages arising from third-party services or integrations
- Damages exceeding the amount you paid in the 12 months preceding the claim
10.3 Medical Disclaimer
YOUTHFUEL IS NOT LIABLE FOR MEDICAL OUTCOMES. ALL TREATMENT DECISIONS ARE MADE BY LICENSED HEALTHCARE PROVIDERS.
11. Indemnification
You agree to indemnify, defend, and hold harmless YouthFuel, Inc., its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses arising from:
- Your use of the Service
- Your violation of these Terms
- Your provision of inaccurate health information
- Your violation of any third-party rights
12. Dispute Resolution
12.1 Governing Law
These Terms are governed by the laws of the State of Florida, without regard to conflict of law provisions.
12.2 Informal Resolution
Before filing a claim, you agree to contact us at support@youth-fuel.com to seek informal resolution. We will attempt to resolve disputes amicably within 30 days.
13. Termination
13.1 Termination by You
You may terminate your account at any time by:
- Accessing your account settings and selecting "Delete Account"
- Contacting our support team at support@youth-fuel.com
Upon termination:
- Your subscription will not renew
- Active prescriptions will be managed per medical standards
- Medical records will be retained per legal requirements
14. Changes to These Terms
We may modify these Terms at any time. We will notify you of material changes by:
- Posting the updated Terms on our website
- Sending an email notification
Your continued use after changes constitutes acceptance.
